Your privacy is important to Bev McGonagle Fitness and I am fully committed to protecting and safeguarding any personal data you share with me. This Privacy Notice sets out the information on what data I collect, how I collect and manage your data and your rights in line with the General Data Protection Regulations (GDPR) 2018 and the Privacy and Electronic Communication Regulations (PECR) 2019.

What information do I collect?
Personal data such as name, date of birth, address, email address, telephone number when you make an enquiry, sign up to my services or subscribe to my emails.
Health data when you complete a Physical Activity Readiness Questionnaire (PAR-Q)
Records of your correspondence with me via my website, email, SMS, Facebook messenger, Instagram, or WhatsApp
Multimedia files such as photographs and video footage of your training in my facility, during classes or at events (your permission will be requested beforehand)
Information obtained from client surveys or feedback requests you have taken part in

How do I use your personal data?
Contract - your personal data is processed in order to fulfil a contractual arrangement.
In order to provide services to you, I need to assess your health, exercise and injury history so I can correctly plan training programmes or ask you to seek medical clearance before participating in any physical activity.
Consent - where you agree to me using your information in this way. I will ask for consent at the point of collecting this data.
Media - to share photographs and video footage on social media or my website
Marketing - to send marketing emails and communications
Legitimate interests - for me to manage my business to provide you with the best possible service.
Communication - to contact you following any communication from you - enquiry or feedback forms, email, text message, messages and comments on social media or any other communication you send to me.
Marketing data - to determine the effectiveness of advertising and marketing campaigns and to provide relevant content on my website and social media pages in order grow my business.
Website data - This website is hosted by Squarespace. Squarespace collects personal data when you visit this website. Squarespace needs the data to run this website, and to protect and improve its platform and services. Squarespace analyzes the data in a de-personalized form.
Special Category Data
The personal data I collect about you when you complete a PAR-Q is classed as special category data as it is more sensitive. I process this data on the basis that it is necessary for the establishment, exercise or defence of legal claims or whenever courts are acting in their judicial capacity.
How may I share your information?
I will not share your data with any third party other than those I use to service my business or if legally obligated to do so. External service providers may be used for processing payments, receipt and storage of information, email marketing, accounting and account management.
Security and Retention of Personal Data
I am committed to keeping your personal data secure, accurate and up to date and only kept for as long as is necessary for the purposes for which it is used. In order to prevent unauthorised access or disclosure, all my electronic devices and cloud storage that hold any information are password protected and any paper records are kept in securely locked storage.
Personal data that I collect from you may be transferred and stored on servers outside of the European Economic Area (EAA). Where this occurs, I ensure the service providers comply with the EU-US Privacy Shield Framework to safeguard your data.
I will hold your personal data securely for as long as you remain a client with me and for up to 7 years afterwards. After this time, any data will be securely disposed of.
Your Rights
You have the right to ask me for a copy of all the information I hold about you, the right to have your information corrected if you believe it is inaccurate, the right to request deletion or removal of your personal data, the right to restrict the processing of your personal data and the right to object to the processing of your personal data.
Marketing and Media
I may send you marketing emails if you have subscribed to my email list via my website or social media link. If you wish to stop receiving any marketing communications from me, you can do this at any time by contacting me directly or follow the unsubscribe link on an email.
If you have given consent for me to take and use photographs or videos of you to use on my website or social media pages, you can withdraw your consent at any time by contacting me directly.

I will not be responsible for the privacy policies of any third party website or apps that you may use, even if linked from my website or through the delivery of my services. I recommend you check the privacy policy of each website or app before using it.
